Please read these Terms and Conditions ("Terms") carefully before using the Niji Dreams mobile application (the "App") operated by Yippeeai Limited ("we", "our", or "us").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
1. Description of the App
Niji Dreams is a visual novel and interactive story game where you explore a coastal town called "The Shore," interact with characters through branching dialogue, play Pachinko minigames, and collect items. The App includes story content, character interactions, minigames, and optional AI-powered chat features.
2. Eligibility
You must be at least 13 years of age to use this App. If you are under 18, you must have parental or guardian consent to use the App. By using the App, you represent that you meet these requirements.
3. User Account
You may be required to create an account to access certain features.
You are responsible for maintaining the confidentiality of your account information.
You agree to provide accurate information when creating your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree NOT to:
Use the App for any unlawful purpose.
Attempt to reverse engineer, decompile, or extract the source code of the App.
Exploit bugs, glitches, or vulnerabilities in the App.
Use automated tools, bots, or scripts to interact with the App.
Distribute, modify, or create derivative works based on the App's content without permission.
Use the AI chat feature to generate harmful, abusive, or inappropriate content.
Harass, abuse, or harm others through any feature of the App.
5. Intellectual Property
All content in the App, including but not limited to story text, dialogue, character artwork, illustrations, background images, music, sound effects, game mechanics, and the "Niji Dreams" name and branding, are the property of Yippeeai Limited and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our express written permission.
6. In-App Currencies and Items
The App features virtual currencies (Stars, Tokens, PachiBalls) and virtual items.
Virtual currencies and items have no real-world monetary value and cannot be exchanged for real currency.
We reserve the right to modify, manage, regulate, or eliminate virtual currencies at any time.
Virtual currencies and items are non-transferable and non-refundable.
7. In-App Purchases
The App may offer in-app purchases in the future. When available:
All purchases are final and non-refundable unless required by applicable law.
Prices are subject to change without notice.
You are responsible for all charges incurred under your account.
Purchases are processed through the Google Play Store and are subject to their terms.
8. AI Chat Feature
The App includes an AI-powered chat feature that allows you to have conversations with characters. By using this feature:
You understand that responses are generated by artificial intelligence and are fictional.
You agree not to rely on AI-generated content for real-world advice or decisions.
Chat conversations are stored locally on your device and can be deleted through Settings.
We reserve the right to moderate or restrict the AI chat feature at any time.
9. Push Notifications
The App may send push notifications to enhance your experience. You can opt out of notifications at any time through your device's settings. Opting out may affect certain features such as daily bonus reminders and story update alerts.
10. Service Availability
The App is provided on an "as is" and "as available" basis.
We do not guarantee uninterrupted or error-free operation of the App.
We may update, modify, or discontinue the App or any feature at any time without prior notice.
We are not liable for any loss of game progress due to device failure, App updates, or uninstallation.
11. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YIPPEEAI LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY ARISING OUT OF YOUR USE OF THE APP.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.
13. Indemnification
You agree to indemnify and hold harmless Yippeeai Limited and its affiliates from any claims, losses, damages, liabilities, and expenses (including attorney's fees) arising from your use of the App or violation of these Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Yippeeai Limited operates, without regard to its conflict of law provisions.
15. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.
16. Termination
We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App will immediately cease.
17. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App. Your continued use of the App after changes constitutes acceptance of the revised Terms.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
